Welcome to Kudo. This Privacy Policy explains how Kudo Graphics, Inc. ("Kudo", "we", "us", "our"), a Delaware corporation, USA, collects, uses, and protects your information when you use our platform and services (the "Service").

The provider of the Service is Kudo Graphics, Inc.

By creating an account or using the Service, you agree to the practices described in this policy.

  • User Content (Inputs and Outputs): We collect and store the files you upload or generate, including but not limited to 3D models, textures, prompts, and the optimized or AI-generated assets ("User Content").

  • Usage Data and Logs: We collect information about how you interact with the Service. This includes your IP address, browser type, operating system, referring pages, access dates and times, and error logs.
  • Cookies and Similar Technologies: We use cookies (small text files) to operate the Service, authenticate your session, and help us understand traffic and usage patterns.

  • If you contact us for support or with questions, we will keep a record of that correspondence.

2. How We Use Your Information

We use your information for the following purposes:

  • To Provide the Service: To operate, maintain, and provide all features of the Service. This includes processing your User Content to run optimizations or generate new assets.
  • To Communicate: To send you administrative or service-related emails (updates, security alerts, policy changes) and to respond to your support requests.
  • To Improve the Service: To analyze usage patterns (in an aggregated and anonymous manner), diagnose technical issues, and improve functionality and user experience.
  • Security and Compliance: To protect the platform against fraud, abuse, and to comply with our legal obligations.

3. OUR COMMITMENT: NO AI TRAINING

Your work is yours. Kudo will not use your User Content (neither your Inputs nor your Outputs) to train or improve any artificial intelligence models, whether Kudo's or any third party's.

4. How We Share Your Information

We do not sell, rent, or trade your personal information. We only share information in the following limited circumstances:

  • Service Providers (Data Processors): We use third-party vendors to help us operate the Service. Our primary infrastructure provider is Google Cloud Platform (GCP). We also utilize Kudo Technologies SAPI de CV in Mexico, for development services. These providers act as Data Processors, are contractually bound to maintain confidentiality, and are prohibited from using your information for their own purposes.
  • Legal Obligations: We may disclose your information if we believe in good faith that it is necessary to comply with a law, subpoena, court order, or other valid legal request.
  • Business Transfer: If Kudo is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

5. Data Security

We implement reasonable technical and organizational security measures (such as encryption in transit and at rest) to protect your information from unauthorized access, alteration, or destruction. However, no system is 100% secure.

6. Data Retention

We will retain your personal information and User Content for as long as your account is active or as needed to provide you with the Service. We may retain certain information for longer periods if necessary to comply with legal obligations or resolve disputes.

We are committed to respecting those rights.

  • Kudo Graphics, Inc. is based in the United States and is assisted by Kudo Technologies SAPI de CV, in Mexico.
  • All information and User Content we process is stored and processed on servers located in the United States (via Google Cloud Platform).
  • If you use the Service from outside the United States (such as from Spain, Mexico, Japan, or LATAM), your information will be transferred to, stored, and processed in the United States.
  • Justification and Consent: We perform this transfer based on Contractual Necessity to execute the Terms and Conditions you accepted (for EU users, this transfer is based on GDPR Article 49(1)(b)). Additionally, by using the Service and accepting this policy, you grant your explicit consent to this international data transfer, as required by laws such as those in Mexico and Japan (APPI).

12. Your Rights and Choices (General)
